Making Money Web

Since a few people told me they found my notes on cloudtop applications useful when I posted them a few months ago, I thought I'd share some more notes in the same spirit.


Part of my immediate motivation was when my friend Andre wrote up some notes on building a Web-scale app in a weekend, Jason Kottke made a smart mention of the difficulty of delivering messages, as evidenced by Jeff Atwood's post earlier this year. If these smart folks are struggling so much, surely there must be another option?


Well, I've noticed a pattern that suggests there is a better way. This time it's not a pattern in end-user applications, but rather in infrastructure services, which I'd call "Delivery as a Service." In this model, new offerings provide a set of message delivery services for developers that share a few common traits:



  • Digital services that pre-date the Web, or were designed without the Web in mind, can now be exposed as simple Web services



  • Legacy platforms that require extremely expensive startup costs convert into a cost-per-message (or cost per thousand messages) model



  • Message systems with effective anti-spam components usually exert a high cost on spammers that can also be a prohibitively high bar for small developers unless they're able to pool their efforts



  • Service providers can aggregate requests from many small, separate applications to make costly services approachable for independent developers



  • You can figure out what the hell these service providers do, unlike many generic Web service providers


With those traits in mind, who's providing Delivery as a Service systems now? I'm sure this is a far-from-comprehensive list (suggestions very welcome!) but these are the few that got my gears turning:



  • Urban Airship: Love these guys. Primarily focused on doing push notifications to iOS-powered Apple devices, they're rapidly expanding into related in-app sales, rich-notifications, and other areas. While Apple does offer an API for its notifications, it's not as easy to use and Web-friendly as UA's offerings, and they handle much of the other infrastructure requirements that would otherwise be onerous.



  • Postmark: Good old-fashioned email! It turns out that, these days, delivering email that doesn't get marked as spam is actually kind of a pain if you're not a huge provider. And much of the commercial email market it optimized for direct marketers. But Postmark has an interesting niche in providing the valuable email capability for developers that don't want to spend precious development cycles on boring-ass email.



  • Twilio: Perhaps the most impressive of the bunch. Twilio handles voice, IVR and SMS functionality for many apps, with a really simple API that any developer can work with.


Now, individually, none of these capabilities are particularly new. (Though of course, iOS push notifications have only been around a relatively short period of time.) But making them broadly available, accessible through simple APIs with code libraries available in common programming licenses, and having initial access be available for pennies or even for free? That represents a big change.

With the proliferation of these services, features that would be "someday" or "after we get funded" features can be pushed up much earlier in a product's lifecycle. And markets that would otherwise be underserved are now approachable; Every company that's putting money into developing an iOS app around their services could use Twilio to provide a robust SMS-based interface at the same magnitude of cost. The early signs of success for each of these little companies is promising too; It might inspire bigger infrastructure providers like UPS (which has its own API for shipping services) to market their services more like these startups as well.


I find delivery services most compelling in the context of how they serve the "cloudtop" apps I described a few months ago, but I can see these being equally important for enterprises or other environments as well. We need more simple services to connect to the real world, to "old-fashioned" technology that isn't Web-centric, but that could still be enhanced by being connected to the Web. Making a RESTful API for faxing might not be sexy, but it could enable some businesses to reach new audiences or do something creative with all of those underutilized rolls of thermal paper. 2010 has seen some really inspiring creative apps become available and here’s our round-up of some of the best. We’re not including expensive pro software here, just mobile and web apps that are either free or available for pocket money. Have your tried all of these?


Instagram


iOS: While there was nothing new about adding cool filters to mobile photos in 2010, Instagram and the similar PicPlz did something a little different with the idea by attaching a social network to the concept.


Being able to view, ‘like’ and comment on other users’ photos in a newsfeed format has turned often throwaway mobile photos into a cult obsession for some, especially on Instagram. Matching a great photo with the perfect filter is a fine art. The ‘Popular’ board on Instagram is full of examples of that delicate balance and trying to match their efforts is truly a joy.


We said: “So why is Instagram so popular? I suspect its a combination of the app’s ease of use, simple design, and artsy filters that make crappy iPhone photos look beautiful, mysterious and engaging.


Buildor


Browser: The idea that a browser could run a Web design application packed with pro-level features would have sounded insane but this year Buildor achieved it with its Buildor Pro app.


Currently in private beta, you’ll need an invite to try this or you can sign up for the waiting list from the website. For Web coders, the app allows you to start a new project from scratch or (most impressively) edit live sites just by pulling up the URL. You’ll need the FTP details for the site if you want to save the results though. For designers meanwhile, Buildor Pro is being pitched as a powerful way of creating HTML mock-ups with full interaction design and font rendering. All of that in a browser – impressive.


We said: “While it remains to be seen whether pro developers will take to browser-based development en masse, there’s a real chance of Buildor disrupting the market if it gains traction.


Soundcloud


iOS and Android: Instant mobile podcasting apps like Audioboo and Cinch are a useful and fun way of recording interviews, speeches or random thoughts and sharing them online from wherever you are. Soundcloud took things a step further with the launch of its iPhone and Android apps this year.


Not only can you instantly record audio and share it to your social networks immediately, by uploading to Soundcloud you get the benefit of the service’s platform. This means that your mobile audio can instantly be used with the wide range of apps that are built to use the Soundcloud API, which opens up a world of possibilities. This is especially useful for musicians, as the service has primarily been music-focused to date. However, with mobile recording, there’s real potential for it to be adopted by a wider range of users.


We said: “SoundCloud has developed into what is now a highly flexible way of working online with any type of audio.


Camera+


iOS: As great as the iPhone 4′s camera is, Camera+ does an excellent job of making it even better. Taking good-looking photos is made easier with the app’s stabilizer, timer and burst features and a fantastic array of image editing and effects tools are built right in.


While it may have been unavailable for much of its life (thanks to an Apple-displeasing ‘Easter egg’ feature that allowed you to use the phone’s volume rocker as a zoom control) that only added to the allure of this app which has been reaping healthy financial rewards for its creators since it returned to the App Store earlier this month.

Whiteboard


iOS: Finger-drawing app Whiteboard became a universal iOS app this year, opening it up to use on the iPad and making collaborative drawing even more fun.


Yes, Whiteboard’s greatest appeal is drawing with friends, either via WiFi or by working together on the same screen – something that’s much easier on the large iPad screen. While you’re never going to paint a masterpiece of contemporary art with this app, it’s possible to lose yourself for hours while you scribble away creating cartoon characters or “improving” photos of friends by adding comedy moustaches and the like.


Air Harp


iOS: Plenty of musical instrument apps have been released for the iPad this year, but one that really caught our eye early on was Air Harp. Offering ample on-screen space for the harp’s fifteen strings, for the first time on a mobile device this really felt like a real instrument.


With its slightly melancholy sound, its can feel a little like a lone minstrel on a hillside at sunset while playing Air Harp. Unlike novelty instrument apps, Air Harp feels like something that you can take the time to learn properly before serenading a loved one with your musical skills. Easy-to-read sheet music makes it simple to play well-known tunes even if you’re far from being a virtuoso.


Nanostudio


iOS: Squeezing an entire music production studio into an iPhone app is a huge achievement, and that’s exactly what Blip Interactive has done with Nanostudio.


Unlike many of the apps on the list, it assumes a certain amount of prior knowledge of how music production works if you want to dive right into it. However, even if you’re a rookie you can get a lot out of this app – you’ll be creating fantastic sounding electronic music in no time.


We said: “The level of control on this app is amazing, every imaginable parameter can be easily edited and controlled – you can even easily move sound files from your PC or Mac via a wireless connection.”


Adobe Photoshop Express


iOS and Android: While a mobile photo editor isn’t going to rival a full desktop experience any time soon, Photoshop Express does a brilliant job of covering the basics of tweaking photos on the go, and for free.


Multitouch gestures let you rotate, crop, straighten or flip images and there are controls for adjusting the tint, saturation, contrast among its useful tools. As with many mobile apps on this list, the iPad version offers more space for controlling your edits while on iPhone and Android handsets it’s simply more convenient as that’s where most of the photos you’ll need it for will be created.

Soundation


Browser: If it looks like there are a lot of audio-related apps, it’s because there’s simply been so much happening in the space this year. Soundation is a cloud-based multitrack recording app and what really makes it stand out is that it offers audio recording right from the browser.


Yes, in addition to importing audio and using the many thousands of loops available within the app, you can plug a microphone right into your computer and sing, play or speak whatever audio you like – another leap forward in what’s possible in the humble Web browser.


SumoPaint


Browser: There are plenty of browser-based image editing tools out there and SumoPaint is up there with the best of them.


Regularly updated with new features, this app is pure pleasure to use and you’ll have to keep reminding yourself that you’re not running a separate app. Layers, blending modes, drop shadows and a wide range of brushes are among the features you might not be used to seeing in browser-based image editors. While professional Photoshop users won’t be ready to switch to the cloud just yet, most beginner and intermediate users will find everything they need here.

Kids Making Money

But in a little-noted provision of its reauthorization of child nutrition programs, signed into law today by President Barack Obama as part of the Healthy, Hunger-Free Kids Act, lawmakers have told schools to raise lunch prices to at least cover what it views as the full cost of making a meal. Entitled "equity in school lunch pricing," the new mandate could, by increasing prices gradually for students whose families aren't low income, pump an additional $2.6 billion into the school meal program over the next 10 years, according to one estimate.


While that's a much-needed infusion of cash, school food services professionals say the move could have the side effect of driving hundreds of thousands of children from the federally subsidized school meals program. The School Nutrition Association (SNA), representing some 50,000 food service workers across the country, likens the new law to cuts in federal support for school meals enacted during the Reagan years, when participation in the National School Lunch Program plummeted 25 percent among full-price students because schools were forced to charge more -- and ketchup was declared a vegetable.


"When you raise prices, it has a real impact on participation," said SNA spokeswoman Diane Pratt-Heavner. "Our members tell us time and time again, even when they raise prices by just a dime, they see participation drop."


"The downside of raising meal prices during these tough economic times is that you run the risk of making the meals unaffordable for kids whose families just barely miss the financial eligibility cut-off," said Kate Adamick, a school-food consultant who has long complained about the pricing disparity. "This is a significant reality in lower-middle class communities, especially for schools located in parts of the country in which the cost of living is extremely high, such as New York City and San Francisco, to name just two. I think this is the right change that may be coming at the wrong time."


Federal subsidies for school meals are intended primarily to help feed low-income children, who receive meals either free or at a reduced price. Even kids who don't qualify and pay "full price" in the subsidized meal line are actually supported by federal funds to the tune of 26 to 34 cents per lunch. But what most schools charge for a full-price meal typically is less than the federal subsidy, currently $1.48 for breakfast and $2.72 for lunch. For instance, here in the District of Columbia, schools serve breakfast free to all students regardless of their ability to pay, while a full-price elementary school lunch is only $1.25, a high school lunch a mere $1.50.


Free breakfasts and underpriced lunches help explain why D.C. schools rack up $7 million in food service deficits every year, or 25 percent of the entire budget.


Critics argue that underpricing also helps explain why schools never seem to have enough money to improve the quality of the food they serve, and that low-income children should not be short-changed in order to support kids who come from wealthier homes, even though there is nothing in federal law to say that government subsidies can only be used to feed needy students. Food service professionals counter that lower prices attract more kids to the meal line, creating economies of scale and helping to lower the marginal cost of meals served in a program they contend is chronically underfunded.


"We all know the effect of higher prices on people's purchasing decisions, and this basic economics lesson applies to school meals as well," Pratt-Heavner said. The new rule, she said, is likely to fall heaviest on families in rural and economically depressed areas where parents "simply cannot afford to pay the higher school-lunch prices charged in wealthier suburban neighborhoods."  


Under the formula approved by Congress, schools that are not charging the full cost for lunch would have to start raising their prices annually by an amount equal to the rate of inflation plus 2 percent. For some schools, getting their prices fully caught up could take 20 years.


A study released in January 2010 by the Center of Budget and Policy Priorities (CBPP), a nonprofit research organization focused on low-income Americans, noted that student payments for federally reimbursable meals account for only about one-quarter of school food-service revenues. The greatest share of income comes in the form of federal subsidies, with sales of competitive foods in á la carte lines (often unhealthy snacks like cookies and chips) and vending machines contributing about 16 percent, and state and local governments chipping in another 9 percent on average.


A study conducted during the 2005-2006 school year by the USDA, which oversees the school meals program, found that the prices schools charged for paid lunches varied widely, from 65 cents to $3, with the most common price being $1.50 -- well below cost. A more recent analysis by the CBPP of the nation's 20 largest school districts found that the average charge for lunch was $1.80 in elementary schools and $2.14 in high schools, still far less than the federal reimbursement rate.


"School districts generally want to set a price that is affordable for the wide range of families with incomes in the paid meal category," the CBPP concluded. "The disparity results in a revenue shortfall that undermines the goal of providing the highest quality meal possible to all students."


The Center on Budget and Policy Priorities cited a USDA study as showing that student participation in the subsidized lunch program was only 3 percent lower in districts that charged $2 per meal compared to $1.50 per meal. But in a program involving more than 31 million children nationwide, that 3 percent would represent nearly 1 million students.


Said the SNA's Pratt-Heavnery: "Unfortunately, no one knows how severe the decline in participation will be as a result of [the new law], and that’s a risky gamble to play with a program that is vital to the nutrition and well-being of millions of school children."
















How much money do NBA players earn in a year? That’s what Jimmy Kimmel decided to ask some children in a segment for his late night show, and their answers are telling (more on that in a second).


It goes without saying that the kids’ concept of money would have the players earning just a fraction less than their current salaries.


While most of the kids believe NBA players earn between between 40 cents and $100 per year, some of the more precocious ones are willing to believe that superstars earn as high as “ten-hundred,” (ten-hundred what of what is never made clear) or even $1,000,000. “Oh come on!” was one kid’s response when finding out the players made more than $3,000.


If the NBA owners had their way, they might make a couple of these guys general managers. Some veteran players believe a lockout for the 2011-2012 is a foregone conclusion, due to owners wanting to drastically restructure salaries. While negotiations are still ongoing, so far, they’ve been fruitless.


At this rate, these adorably wrong kids may turn out to be horrifyingly right: NBA players could be making nothing come next October.

Secrets to Making Money

I have never been one to read books or PDFs on my computer screen. Give me a paperback book, or a printed page, and I can get through it quickly, but sit me in front of a screen and I just can’t make myself read it. Now with the advent of eReaders like the Kindle, and tablets like the iPad, reading a book off a screen isn’t as hard as it used to be.

There is no end to the wealth of free eBooks available online today, from literature to books on social media, to teaching yourself how to use Linux. There is one topic, blogging, with countless eBooks available, both paid and free, and it just takes a little bit of digging to find some of the best ones out there. Making Money From the Internet


The last time she hooked up, she said, it was because “his personality put me at ease. He was straight to the point. He asked me the same questions I was asking him.” Plus, she liked that his real name matched his email address. From there, she was able to find his Facebook page, with numerous photographs. When Ashley (not her real name) finally had her rendezvous, she took down his license plate number and texted it to herself on a second cellphone, which she’d left on her kitchen table along with a note for friends and family, just in case she didn’t return. And then she collected her $500 an hour.


Welcome to prostitution in the Internet era.


Fifteen years ago, it was hard to find hookers on the Web. Now they are all over the place. The Internet has given rise to a new generation of sex workers who have more autonomy than ever before, and by and large enjoy a level of safety not shared by their street-walking sisters. Nonetheless, Internet prostitution is a risky business, and those hazards were underscored this month when the bodies of four women were found decomposing on the side of the road near Jones Beach on Long Island. Attention quickly turned to two missing call girls who’d been using Craigslist as their primary means of making connections. It turned out that neither woman was among the victims, but the grisly discovery put an unwanted spotlight back on Craigslist, which in September took down its U.S. erotic-services directory under pressure from law enforcement and human-rights groups. Last week, it pulled its worldwide adult-services ads. (Though Craigslist has managed to get most sex solicitation off its site, it hasn’t completely succeeded, as Ashley can tell you.)


David Henry Sterry has numerous stories about how the lives of prostitutes have changed in the past decade. Last year, he edited Hos, Hookers, Call Girls, and Rent Boys: Prostitutes Writing on Life, Love, Work, Sex, and Money, an anthology that received a stamp of approval from The New York Times. He’s also a former sex worker himself, a rare example of a man who earned his living pleasing older women. (The only common thread connecting his clients, he said, was that they all had money and “most felt powerless because they were housewives, bored, and rich.”)


One of the women who appeared in his book called herself Kat, worked on Craigslist, and had an elaborate screening process in which she would force potential johns to drive up to the location of the assignations, get out of their cars, and stand there while she examined them from a nearby window with a pair of binoculars. Kat refused to talk to anyone with a blocked number. She also chose not to text. If you sent her a photo of your genitalia, a common mistake among potential johns, you were out of contention. “She had developed what she called a ‘hooker’s radar,’” Sterry said. “The tone of the guy’s voice, his walk, she had learned how to instantly size someone up. And if the guy looked sketchy or too much like a toad, she would stop returning his phone calls.”


“People who think they’re going to eliminate prostitution or violence in prostitution by shutting down Craigslist are wildly deluded,” said David Henry Sterry.








Another Internet-era phenomenon that’s friendly to business and helps boost security for prostitutes and johns alike is “the mixer.” This is a cocktail party-like event at which “hobbyists”—the current euphemism of choice for high-spending porn aficionados obsessed with bonking their favorite screen stars—get to meet potential dates. No sex typically takes place on site, explained Daily Beast contributor Richard Abowitz, a chronicler of life in Las Vegas, where the parties frequently occur. “It’s more like a job fair,” he said.

** The Innocence Project. Hundreds, if not thousands, of Americans sit in prison tonight having been wrongly convicted of a crime. They are 100 percent innocent and the system has the DNA samples to prove it. The Innocence Project is an amazing group that provides free attorneys and researchers who devote their time to freeing these innocent men and women. It's no mistake that human rights groups place the United States on their list of countries who throw the innocent behind bars. No country on earth (including China, with four times the population of the United States) has more people in prison than America. Please give to the Innocence Project so that those who've committed no crime do not spend another night in jail -- and so I don't have to spend so much time on Christmas Eve going through security when I make deliveries to them.



** The Bradley Manning Defense Fund. If I witness a crime while making my rounds on Christmas Eve, and I report it, I'm considered a hero. (Sometimes there's reward money!) Private Bradley Manning of the United States Army allegedly came across video of his fellow soldiers gunning down and killing in cold blood two reporters from Reuters and a group of Iraqis who were civilians. He apparently decided to report this crime to the American people. For this, he has been arrested and thrown into the brig -- where he has sat in tortuous solitary confinement for seven months. He is also believed to be the source of thousands of documents obtained by WikiLeaks which show the disgusting and immoral behavior of your government and Pentagon as they've prosecuted two illegal wars in Iraq and Afghanistan. This is a true travesty taking place and it's being done in your name. Please contribute to his legal defense fund and please send him a holiday card at:

** WikiLeaks. What more needs to be said? Frankly, in retrospect I'm GLAD they leaked my 2009 Naughty & Nice list -- especially the parts about the U.S. government. I know that may hurt a bit for those of you who are Americans, but trust me, it's good for you in the long run. What I do foresee in the coming year, though, is a battle for who controls the internet -- and those in power are going to find ways to clamp down and not make it so easy for all of us to share with each other so freely. (Another good group to give to that is helping to keep the internet free is Save the Internet.) From the Iraq War video to the proof that you're backing a corrupt government in Afghanistan to the fabricated cables sent to the Bush State Department from Havana about Mike's movie, WikiLeaks has performed an invaluable service. As long as they don't dig into what my elves do in the 11 months they're on vacation, I'm solidly behind WikiLeaks.



** The Water Project. Over a billion people on this planet have no access to clean drinking water. Approximately 2 million children under age 5 are killed each year worldwide by a water-related disease. This is insane considering we have the technology and the people power to fix this in a very short time period -- if we wanted. The money from just one year of the Iraq War would pretty much take care of it. Sad, isn't it, how we're capable of so much more, of being so much better. The Water Project is a hands-on, boots on the ground organization that's digging wells and getting clean drinking water to the Third World. This is one delivery -- water for a billion people -- that just doesn't fit in my sleigh.



** Park 51 Islamic Community Center ("The Ground Zero Mosque"). Here's a tip: if there's anything that will get you a lump of coal in your stocking, it's hating people based on their race or religion. And I'm sorry to say, folks like that were out in full force this year. They even won themselves an election. Soon they will hold congressional hearings to out America's Kenyan-born Muslim president. (My team's already getting extra coal ready for Christmas 2011.)



Meanwhile in lower Manhattan, a group of people who happen to be Muslim want to build a community center. They asked the Jewish Community Center in Manhattan for help. They helped them. It was so nice it made me think I should branch out into Hanukkah and Ramadan. Then the haters showed up. But I believe Park 51 will win this fight. Please help them.



** Democracy Now. This great daily show presents the news we never get to hear on mainstream radio or TV -- especially at the North Pole, where for some reason the cable system only runs the Hallmark channel and Spike. Amy Goodman and Co. do an incredible job bringing the truth to the American public every morning. I listen to them and I support them. (And I support all efforts for non-profit, community-based radio stations. You can learn more about that movement at Radio for All.)



So give if you can. I know these are tight times for most people and you've got yourselves and your families to take care of. I hope this time of the year is going well for you and if not, then please know that there are many -- including me -- who care about you and yours. Working together, it will get better for everyone.

Women Making Money





This is the final in a three-part series. Read Part 1 here and Part II here.



In the previous two parts of this series I have recounted the multiple frauds perpetrated by MERS: it defrauded counties out of billions of dollars of reporting fees, it defrauded homeowners by destroying documents that provide a clear chain of title -- facilitating its foreclosure frauds, and it defrauded securities investors by failing to adhere to PSAs (pooling and servicing agreements) -- making their securities invalid. Now, in order to cover the trail of deceit MERS and the banks are stealing homes as fast as they can in the hope that no one will notice the fraud. Meanwhile, they are destroying real estate values and adding to the headwinds that are pushing our economy into the first great depression of the 21st century.



In this piece, let us step back and examine the big picture to answer the question: Why did Wall Street create this crisis? For the answer, we have got to go back several decades. I do not want to give a long-winded history lesson, but it is necessary to understand the transformation that has taken place since the 1960s. Back then, the financial system was small, simple, regulated and relatively unimportant. Banks made commercial loans; thrifts made home loans; and Wall Street handled investment finance. Households had jobs and rising wages so they didn't need to go into debt to finance rising consumption. With robust economic growth, each generation could expect to have roughly twice the living standard of the previous generation.



Things began to change in the 1970s, and especially in the 1980s as growth slowed, as median real wages stopped rising, and as financial institutions were unleashed to expand activities into new areas. At first households coped with stagnant incomes by putting more family members to work (especially women), but gradually they began to rely on debt. Banks created new kinds of credit and gradually expanded their views as to who is creditworthy. I can still remember one conference I attended at which someone from the financial sector proudly announced that the banks had discovered an untapped market for credit cards -- the "mentally retarded". The argument was that this group would be just as safe as college students, since parents would bail them out in order to avoid having their kids' credit ratings suffer. This was not a joke -- it was a business model.



With slower economic growth, it had become harder for American firms to make profits. They shifted their focus from actually producing goods and services to making money on financial products. GM and GE became primarily financial institutions that happened to make cars and light bulbs as a sideline business. Yes, you could buy a car made by GM, but the company made most of its profits on the auto loan. (It then branched out to -- you betcha -- mortgage backed securities and all other manner of risky assets. I hope readers understand that that is what the "auto" bail-out was all about.) As everyone got into the act of indiscriminate lending, banks found their own business dwindling -- so they had to continually innovate with new products and to find new activities to finance.



The economy became "financialized", as financial institutions inserted their activities into virtually every aspect of American life. Health care morphed into financialized health "insurance", given a huge boost by "Obamacare" legislation that for the first time in US history mandates that Americans turn their incomes over to private financial firms. Even death became financialized with "peasant insurance" (employers take out contracts on employees) and "death settlements" (life insurance policies on those with fatal illnesses are securitized and sold to gamblers betting on early death). Retailers increased the financialization of consumer goods -- they couldn't get enough profit on the sales or even on the consumer credit, so they offered "extended protection" on everything from TVs to toasters and then tried to scare customers with an unusual marketing pitch: the products they carry are so shoddily produced that insurance is necessary to protect the purchase.



Every kind of debt or insurance product became a financial commodity, packaged into a security and sliced and diced and bought and sold. At the same time, "insurance" (often in the form of credit default swaps) replaced underwriting (credit assessment) to make these loans more marketable. And then the credit default swap insurance, itself, became a way to bet on the death of securities, companies, and even nations. It is not a stretch to say that Wall Street's capitalists returned to their roots as "undertakers" (the old term for entrepreneurs), with death becoming their main line of business.



Debt grew. In 2007 just before the crisis hit, total US debt reached five times national income -- the previous record was just three times income, a level reached in the propitious year of 1929. In other words, each dollar of income had to service five dollars of debt. In the decade previous to the crisis, American households spent more than their incomes in almost every year. For every debtor created there is a creditor. Not surprisingly, creditors are richer than debtors. Over time, the proportion of Americans who were debtors grew, and the proportion of creditors fell. The rich got richer and every one else either got poorer or at best just managed to break even. In other words, the debt train fueled a massive redistribution of income and wealth to the very top. It is no coincidence that inequality in the US has returned to its previous peak -- reached, not coincidentally also in 1929. That is what President Bush actually meant when he talked about the ownership society -- a society in which a small elite would own everything.



Banks became giant one-stop casinos that facilitated every kind of crazy bet. They would make a loan to you, but then simultaneously securitize it to sell-on to an investor plus place a bet that you would default on your loan so that the security would go bad. For a fee, they'd let a hedge fund manager choose the riskiest loans to bundle into a sure-to-fail financial product that they would then sell to their own customers. And then they'd join the hedge fund in betting against their customers. The more loans they made, the more fees they collected; the more bad loans they made, the more bets they would win. The more debt they piled on households, the greater their profits; riskier debt meant even higher fees and more defaults and thus greater wins from gambling. Prospective death was a booming good business for our undertakers.



America became "Bubbleonia" -- with a "bubblicious" economy that moved from one bubble and crash to another: A commercial real estate bubble and crash in the 1980s that killed the thrifts; a series of developing country debt bubbles and crashes in the 1980s and 1990s fueled in part by American banks; a US stock market bubble and crash in 1987; the dot-com bubble and crash at the end of the 1990s; and then the US real estate and global commodities markets bubbles and crashes this decade.



Increasingly, the bubbles were managed cooperatively by Wall Street and Washington. Chairman Greenspan and President Clinton made a pact with Robert Rubin's Wall Street to pump up "new economy" internet stocks through "irrational exuberance". When that failed, Greenspan extolled the benefits of adjustable rate mortgages, while President Bush hawked the "ownership society". Wall Street turned America's residential real estate sector into the world's biggest casino -- $20 trillion worth of property that could serve as the basis for many tens of trillions of dollars of bets. Bernanke promoted the bubble by assuring markets that America was enjoying the "great moderation" -- a new era in which stability dominates -- and that in any case, the Fed would protect markets in the case of any hiccups.



The home finance food chain was fundamentally changed to facilitate the rapid pace of gambling that would be necessary to feed Wall Street's appetite. Real estate appraisers were paid more to over-value homes; mortgage brokers were rewarded with higher fees to induce borrowers to accept unfavorable terms; mortgage lenders got better fees for riskier loans; securitizers wanted more junky loans to increase the projected returns spit out by their own internal models that presume more risk is always rewarded with higher profits; credit raters got paid to rate trash as AAA -- as safe as treasuries; and investors shunned "plain vanilla" securities in favor of risky structured products that were so complex no one could understand them -- so that they could have any value desired. No worries, AIG sold "insurance" on all this garbage!



That homeowners would default on the unaffordable mortgages was a foregone conclusion. Indeed, it was the desired result of the business model. The preferred marketed loans tell it all: Subprimes! NINJAs! Liar's loans! Washington helpfully changed bankruptcy law to make it more difficult for a homeowner to get out of mortgage debt in preparation for the wave of defaults that everyone knew would result. Wall Street would get the homes, and homeowners would still have to pay on the debts. Then the foreclosed property would be resold, with more fees for everyone in the finance food chain, and the whole process through to default would begin again -- a nice virtuous cycle.



It might seem strange that banks would actually want default. But that is the beauty of a casino -- the house always wins, and homebuyers were gambling against the casino. On the way up, fees are collected, and on the way down fees are still collected on the foreclosures and as houses are resold. And if anything should go wrong, Washington backstops the casinos.



But it was necessary to streamline foreclosure to make it as fast and cheap as possible. Enter MERS -- another link in the food chain -- created by the banks in 1997 in preparation for the boom and bust. MERS was set up to be a foreclosure mill. It would break the centuries-old custom that protected property rights by requiring every sale of property to be publicly recorded, and requiring that any creditor claiming a right to foreclose to demonstrate clear title, with an endorsed note in the creditor's name and a record at the county office showing transfer of the property.



The banksters did not want to go through all that paperwork, and needed to subvert the transparency that would shine light on their crimes. Hence, they set up a fraudulent shell corporation that claimed to be the mortgagee; while the original sale would be recorded at the county office, subsequent sales and purchases of the mortgage would be recorded only by an "electronic handshake" between two "members" of MERS. Even that record was considered by the banksters to be purely voluntary -- MERS did not require members to actually record transactions. If they found it more convenient to conceal the transfers, that was permitted.



MERS even farmed out its name -- for 25 bucks anyone could buy the MERS trademark and use it. And in a touching display of fraternity, everyone got to be a certified vice president of MERS. (Sort of like those 1950s marketing campaigns advertised on cereal boxes -- for 25 cents, you too can be a Super Fraudster with a nifty membership ring and all the benefits of membership in an international criminal conspiracy!)



MERS deliberately undermined the legality of the loans and the records. Homeowners could no longer search the public records to find out who actually held their mortgage -- the record would show MERS as owner, but MERS was a shell corporation with no real employees. It was not a servicer, so the homeowner could not make mortgage payments to the purported owner. As a result, checks were sent to the wrong servicers; servicers credited the wrong accounts; servicers claimed delinquencies on homeowners who never missed a payment, and piled late fees and delinquencies on the wrong borrowers; sheriffs were sent to break down the doors of the wrong houses, and threw belongings out on the street in front of homes on which there was no mortgage at all. MERS purposely created the mess, at the behest of banksters who do not want mere legal technicalities to get in the way of stealing homes. The undermining of the public records was not a mistake -- it was MERS's business model, created by the member banks.



And MERS helped banksters to defraud securities holders. Banks not only separated the mortgages from the notes, but they even destroyed the notes as they entered the mortgages into MERS's electronic data base. MERS told servicers that it is "customary" practice to retain notes, not to endorse them over to REMIC trustees as required both by federal tax law and by the PSAs that govern the trusts. This made the securities a "nullity" -- as the Supreme Court ruled over a hundred years ago -- because a mortgage without a note is unenforceable in foreclosure. At best, the securities are unsecured debt, with no real property behind them.



In any case, the mortgages put into the trusts did not meet the representations made to investors -- so even if the notes had been properly endorsed over to the trusts, the securities could be turned back to the banks. By creating a completely fraudulent electronic registry system -- in which data would be entered only if banks found it convenient to do so, and in which data could be modified at any time by any member of MERS -- MERS made it easy to conceal the securities frauds. Destruction or forgery of the paperwork was absolutely necessary to cover the trail of fraud from origination of the mortgage to securitization and finally to the inevitable foreclosure. Again, destruction of documents was not a mistake. It was the business model.







What huge tax break?



You couldn't possibly be talking about what the President and Congress are debating since there is no "break" involved as it still preserves a much higher tax rate for upper income and is exactly the same as the current rate. Besides that tax rate is more relevant to upper-middle class people in major high cost markets than to the rich like the Madoff relatives. They have most of their wealth protected in investment gains and LLC's, all of which get much lower tax rates than ordinary income and were not even on the table for change during or before the current bill floating around Washington. Which is why the Fortune 500 have an effective tax rate almost half as much as the upper-middle-class who are hit by the highest ordinary income tax rate and AMT. If your goal is the "tax the rich" some more, you need to focus on capital gains and corporate tax rates and loopholes (like the ability for rich investors to hide gains by "reinvesting" them back into their funds but then take no interest loans from those investments).



And if your goal is "social justice" or some "fair" distribution of taxes, start by recognizing that 50% of taxpayers end up netting $0 federal payment and 40% get refunds in excess of payments, which means that tax dollars are flowing straight from those 1-in-2 who really pay taxes through to these people's personal wallets without contributing at all to federal expenses. So effectively a big part of our tax system is a straight up alternative form of welfare, operating on top of any other federal or state welfare programs. Why not make taxes really go toward expenses or debt?
